Last week, the Department of Justice issued a proposed rule that would remove current and former Department of Justice lawyers from the existing disciplinary system that applies to all practicing lawyers in the U.S. (Disciplinary authorities have authority overall practicing lawyers, including DOJ lawyers.) The proposed rule would give the DOJ “the right to review the allegations, and request to suspend any investigations until the completion of the Department’s review.”

There is no legal basis for removing a state’s power to investigate a lawyer, turn the case over to the DOJ, and suspend any pertinent investigations until the DOJ has issued a decision. This proposed rule is open to the public for comments until April 6.
